Terms for using the Hashbang website, business inquiries, and beta-interest forms.
1. About these terms
These Terms of Service ("Terms") govern your use of the Hashbang, Inc. corporate website at hashbanginc.com and its hashbanggames.com alias, including its content, inquiry forms, and beta-interest forms (the "Website"). "Hashbang," "we," "us," and "our" mean Hashbang, Inc. By using the Website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please stop using it.
These Terms do not replace a signed services agreement, statement of work, game end-user license agreement, game-specific terms, or a platform's terms. A more specific agreement governs its own subject matter if it conflicts with these Website Terms. Game access, player accounts, virtual items, in-app purchases, advertising, and gameplay are subject to the applicable game and platform agreements, not a purchase or license created merely by viewing this Website.
2. Eligibility and authority
You must have legal capacity to enter these Terms. Our business inquiry and beta-interest forms are for adults aged 18 or older. If you use the Website on behalf of an organization, you represent that you have authority to act for it. You are responsible for complying with applicable laws and for providing accurate information when communicating with us.
3. Permission to use the Website
Subject to these Terms, you may access the Website and view its publicly available materials for lawful personal use or to evaluate our business services and work. This limited permission does not transfer ownership or authorize commercial redistribution, resale, sublicensing, or use of our content to misrepresent an association with us.
You are responsible for your internet connection, device, and related charges. We may change or discontinue Website features, fix errors, or perform maintenance. We do not promise that every feature will be available continuously or in every location.
4. Intellectual property and portfolio credits
The Website's design, code, text, branding, and other materials belong to Hashbang or their respective owners and are protected by intellectual-property laws. Game names, logos, characters, screenshots, and client or publisher marks shown in our portfolio remain the property of their respective owners. Portfolio presentation describes our work and does not grant you a license to those games or third-party materials.
Except as permitted by law or written authorization, do not copy, modify, distribute, publicly display, sell, or exploit protected materials, remove ownership notices, or use Hashbang names or marks in a way that implies endorsement. Ordinary linking to public pages is allowed if it is accurate, lawful, and does not misrepresent affiliation.
5. Acceptable use
You agree not to:
- Use the Website for unlawful, fraudulent, deceptive, threatening, or harassing activity, or infringe another person's rights.
- Introduce malware, attempt unauthorized access, probe systems without permission, bypass access controls or rate limits, or disrupt availability.
- Use forms for spam, impersonation, bulk solicitation, or irrelevant automated submissions.
- Collect personal information about other people through the Website without a lawful basis or misrepresent information you submit.
- Use automated extraction in a way that circumvents technical controls, imposes unreasonable load, or infringes rights. Ordinary search indexing subject to published crawling rules is not prohibited by this clause.
Nothing here restricts a non-waivable legal right, lawful reporting to authorities, or security research explicitly authorized by us.
6. Your inquiries, materials, and feedback
You retain ownership of information and materials you submit. You give us only the permission reasonably necessary to receive, store, review, and respond to the submission and provide a service you request, subject to our Privacy Policy and any separate agreement. You represent that you have the right to provide it and that it does not violate another person's rights.
Do not use an ordinary website form to send secrets, credentials, sensitive personal information, or confidential project materials that require a nondisclosure agreement. A submission alone does not establish a confidential relationship or obligate us to accept confidentiality terms attached to it. A separately signed confidentiality agreement controls where one exists.
If you voluntarily provide general suggestions about our Website, you permit us to use that feedback to improve it without an obligation to pay compensation. This does not transfer ownership of your project, confidential materials governed by an agreement, or personal information.
7. Business inquiries and service engagements
Website descriptions, examples, estimates, and discussions are informational and are not an offer that creates a services contract on submission. Sending an inquiry does not reserve capacity or establish a client relationship. Project scope, deliverables, fees, payment schedules, intellectual-property rights, confidentiality, support, and other commercial terms must be agreed separately in writing by authorized representatives.
We may decline an inquiry or request further information. You should not rely on a portfolio result as a guarantee that another project will produce the same outcome.
8. Beta-interest submissions
A beta-interest submission is a request to be considered, not guaranteed admission, employment, compensation, or a product purchase. Availability, supported platforms, schedules, selection criteria, and capacity may change. If invited, you may need to accept separate testing or game terms and satisfy platform and age requirements before access.
Beta software may be incomplete, contain errors, change substantially, or lose test progress. The terms accompanying an actual beta govern participation. Submitting interest does not automatically subscribe you to unrelated marketing.
9. Third-party links and platforms
The Website links to publishers, app stores, recruiting services, social networks, and other third parties. We do not control their content, availability, practices, transactions, or contractual terms. A link does not itself guarantee or endorse their services. Review their terms and privacy notices before interacting with them. Purchases made through a game or store are governed by the applicable purchase, refund, and platform rules and your statutory rights; this corporate Website does not process such purchases.
10. Privacy and cookie choices
Our Privacy Policy explains how we handle information through the Website and how to make privacy requests. Optional analytics choices are separate from acceptance of these Terms. Using the Website or submitting an inquiry does not, by itself, consent to optional analytics or marketing. You can review website storage choices using Cookie settings in the footer.
11. Information and availability
To the extent permitted by applicable law, the Website is provided on an "as is" and "as available" basis without promises that it will be uninterrupted, error-free, fully current, or suitable for every purpose. We do not make implied warranties of merchantability, fitness for a particular purpose, or non-infringement to the extent those warranties may lawfully be disclaimed.
We make reasonable efforts to present useful information, but project descriptions, job listings, supported platforms, and availability can change. Verify material details with us before relying on them. Nothing in these Terms excludes warranties, remedies, or consumer protections that cannot lawfully be excluded.
12. Responsibility and limits
To the extent permitted by law, Hashbang is not liable for indirect, incidental, special, or consequential losses arising from use of, or inability to use, this informational Website, including lost business opportunities or lost profits, where such exclusions are lawful. We remain responsible to the extent required by applicable law, and no clause excludes liability for fraud, willful misconduct, or any other liability that cannot be limited.
A separate services or game agreement may contain different terms for that service or game. These Website Terms do not reduce rights or remedies granted under such an agreement or mandatory consumer law.
13. Suspension and ending use
You may stop using the Website at any time. We may restrict access or reject submissions where reasonably necessary to protect security, investigate abuse, enforce these Terms, or comply with law. Where appropriate and feasible, we will give notice or an opportunity to address the issue. Ending Website access does not automatically terminate a separate contract or erase information that must lawfully be retained.
Provisions intended to continue by their nature, including ownership, responsibility, and dispute provisions, survive the end of use.
14. Applicable law and disputes
These Website Terms are governed by the laws of Washington State, United States, without regard to conflict-of-law rules, except where the mandatory law of your place of residence requires otherwise. The mailing address below does not determine the applicable law. Nothing in these Terms deprives a consumer of mandatory local protections, available local courts, or the right to complain to a regulator.
If an issue arises, contact info@hashbanginc.com with a description and your requested resolution so we can try to resolve it. This request does not impose mandatory arbitration, waive class-action rights, or prevent either party from seeking a remedy permitted by law.
15. Changes and general provisions
We may revise these Terms and will show the effective date. Material changes will receive notice or renewed agreement where required by law; revisions will not retroactively change an existing signed agreement. If a provision is unenforceable, the remaining provisions continue to the extent lawful. A failure to enforce a provision on one occasion is not a waiver. These Website Terms and any terms expressly incorporated for Website use constitute the agreement for that use, without displacing separate signed or product-specific agreements.
